AVILA RESTAURANT & BAR REWARD SCHEME TERMS AND CONDITIONS
The Reward Scheme and its benefits are offered at the sole discretion of Avila Restaurant & Bar. Avila Restaurant operates as hospitality venture offering customers dine-in and takeaway services of its products which in this instance covers all dishes published on its menus.  As part of its services Avila Restaurant & Bar offers the scheme to Customers allowing them to collect and spend accumulated stamps. This page sets out the terms of the Reward Scheme. These terms and conditions govern the collection and use of stamps by Customers and govern the contract between Customers and Avila Restaurant & Bar as further detailed in these Conditions.
 
INTERPRETATION 
  (a) The following definitions and rules of interpretation apply in these Conditions which include the introductory paragraphs.
(i) Account means the Member’s personal account with the Program where details of his Stamps and Rewards are maintained.
(ii) Customer means a person who uses the products or services of Avila Restaurant & Bar and who is eligible for membership of the Program.
(iii) Claim means a Member’s claim for stamps to be awarded to his card in accordance with these Conditions.
(iv) Reward Scheme website means www.avilarestaurants.com/reward
(v) Member means a customer who has been awarded a Reward Card by Avila Restaurant & Bar.
(vi) Stamps mean the Reward print awarded to a Customer’s Card in respect of a Qualifying Spend.
 
Rewards means:
(a) The various products and services and other offers made available from time to time by Avila Restaurant & Bar to Customers in consideration of the redemption of stamps. 
(b) Headings in these Conditions shall not affect interpretation of them. 
(c) A person includes a natural person, (whether having separate legal personality or otherwise) unless the context otherwise requires. 
(d) Any obligation in the Conditions on a person not to do something includes, without limitation, an obligation not to agree, allow, permit, or acquiesce in that thing being done. 
(e) References to Conditions are to these Conditions.
 
CONDITIONS OF MEMBERSHIP 
(f) To be eligible for membership under the Program, the Applicant must: 
(g) Be a natural person (and for the purposes of this Condition (g), Condition (c) shall not apply)
 (i) be at least 18 years of age. 
(ii) have a resident UK address. 
(h) A Customer may only hold one Reward Card at a time. 
(i) Employees of Avila Restaurant & Bar are not permitted to partake of the reward scheme. 
(j) Avila Restaurant & Bar reserves the right to reject customer interest in the scheme if: 
(k) the conditions set out in Condition (g) are not satisfied, or it has reasonable grounds to believe that to be the case; or 
(iii) the person is an employee of Avila Restaurant & Bar; or 
(iv) the customer already holds an unused reward card; or 
(v) Avila Restaurant & Bar has any other good reason which shall be determined in its sole discretion.
 
APPLICATION OF CONDITIONS 
(l) Customers must obtain the reward card from authorised personnel. The reward card constitutes an offer by the customer to partake of the scheme in accordance with these Conditions. 
(m) Avila Restaurant & Bar reserves the right to amend the Conditions from time to time and shall notify Customers of any changes by posting them on the Website and on in Restaurant notices. 
(n) Avila Restaurant & Bar will also attempt to notify Active Customers of the scheme changes by email but will not be liable for failure to do so, and the collection of or redemption of stamp shall be considered acceptance of the new Conditions. 
 
CANCELLATION OF MEMBERSHIP BY AVILA RESTAURANT & BAR. 
Avila Restaurant & Bar may by written notice cancel any Customer’s reward card and revoke any and all unredeemed Points if the Customer: 
  1. breaches the Contract. 
  2. supplies false or misleading information to Avila Restaurant & Bar; 
  3. misuses the Program (such misuse to be determined by Avila Restaurant & Bar at its sole discretion); 
  4. is guilty of any violation of any law or regulation in connection with the use of reward benefits;
  5. commits a fraud involving any portion of this Scheme; 
  6. has more than one active card; 
  7. otherwise ceases to be “eligible” as determined under Condition (g); or 
  8. acts, in any other way, to the detriment of the Scheme, as may be determined by AVILA RESTAURANT & BAR at its sole discretion.
 
PROGRAM AVAILABILITY AND TERMINATION
AVILA RESTAURANT & BAR reserves the right to restrict, suspend, discontinue, or cancel part or the whole of this Scheme upon 30 days written notice posted on the Reward page on the Website and restaurant display notices. No further claims for reward will be accepted after the date of the Termination Notice and any claims made but not approved by that date will be deemed invalid and declined. 

 

DATA PROTECTION AND PRIVACY POLICY 
All information collected by Avila Restaurant & Bar from Customers shall be processed and stored in accordance with Avila Restaurant & Bar’s Privacy Policy (which forms part of these Conditions).
REWARD STAMPS
     1. AWARD OF REWARD STAMPS
Reward stamps are awarded by AVILA RESTAURANT & BAR to Customers for each Qualifying Purchase. 
Reward stamps are accumulated in accordance with the number of times purchases are made up to the qualifying stamp as stated on the Reward Scheme page on the website. 
Reward stamps are awarded on full pound sterling expenditure and are not awarded on fractions of pounds sterling spent.
     2. POINTS HAVE NO VALUE
Stamps are not redeemable for cash or any other form of credit and have no cash value until presented for redemption in accordance with the Program. 
Use of the word “earn” in the Conditions and other documents and materials in relation to Stamps shall mean “collect” and shall not infer that the Stamps have any value until they are presented for redemption. Reward Stamps may not be purchased or sold and are not transferable other than in accordance with the Conditions.
     3. RETROSPECTIVE CLAIMS ON JOINING
Upon enrolment, Customers may not claim Stamps for purchases previously placed at the Restaurant whether as dine-in or takeaway.
     4. OTHER MATTERS 
Stamps collected and membership of the Scheme is personal to the Customer and cannot be transferred. 
Avila Restaurant & Bar may transfer its rights and obligations under these Conditions to another organisation and will notify Customers in writing if this happens.
For the avoidance of doubt Avila Restaurant & Bar reserves the right to delete, add, modify or substitute Rewards or Redemption Partners in this Program at any time.
Each of the paragraphs of these Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 
These Terms are governed by English law. The parties agree to submit to the non-exclusive jurisdiction of the English courts.
